When background checks or record searches are run for your name, if you have a non-conviction record due to your arrest, information about you is often disclosed as it is still kept on file by the arresting police service. This includes:

  • A record indicating that a charge was filed against you
  • Your fingerprints
  • Photos of you
  • Other information that was disclosed when you were arrested.

File Destruction Process

Across Canada, each local police service has its own policies and procedures related to criminal record retention policies. These procedures must be satisfied to have a record destroyed. Assured Pardons of Canada will:

  • Obtain all of the necessary court information on your behalf
  • Research the arresting police file destruction policies ensuring all requirements are met to have the record destroyed
  • Petition the arresting police service to destroy all non-conviction files relating to your case and remove the record from the Canadian Police Information Centre (CPIC) database

Here are a few things to be aware of:

  • The file destruction process may take up to 8 months.
  • If it is deemed in the public's best interest, police have the legal right to retain files
